Welcome to Picture Music — an album that sings, one memory at a time. By using this app, you agree to the terms below.

i.Service Description

Picture Music is an iOS application that turns a photo you pick from your library into a one-of-a-kind “memory song”: a short, AI-composed piece of music made for that single image. The composer is provided by a third-party AI service. The app also includes optional online music search and playback, video export of finished memories, and a local library that keeps your memories indexed by date.

ii.Plans & Pricing

Picture Music offers one free tier and two auto-renewing subscription plans. Daily and per-period quotas may be adjusted via remote configuration; the values below reflect the current defaults.

iii.Auto-Renewal & Cancellation

• Subscriptions automatically renew at the same price and duration unless cancelled at least 24 hours before the end of the current period.
• Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.
• You can manage and cancel subscriptions at any time in your Apple ID Account Settings — Settings › [your name] › Subscriptions.
• Cancellation stops future renewals; the active period remains usable until it expires.

iv.Quota & Reset Rules

• Each memory song consumes 1 generation quota unit and produces one song. If composition fails after the quota is consumed, the quota is automatically refunded.
• Each download consumes 1 download quota unit (Free plan only; subscribers have unlimited downloads).
• Free plan: both generation and download quotas reset at local-time midnight each day. Unused quota does not carry over.
• Basic plan: generation quota resets every 7 days, anchored to your subscription purchase date. Downloads are unlimited. Unused generation quota does not carry over to the next period.
• Premium plan: generation quota resets every 30 days, anchored to your subscription purchase date. Downloads are unlimited. Unused generation quota does not carry over to the next period.
• Upgrading your plan (e.g., Free → Basic, Basic → Premium) immediately resets your generation quota to the new plan’s allowance.

v.Downloads & Offline Playback

• Free users may download tracks within the daily download quota, but playback of downloaded audio files requires an active subscription. Downloaded files stay on your device for future use once you subscribe.
• If you cancel your subscription, previously downloaded files remain on your device, but offline playback will no longer be available after the active period expires.
• Basic and Premium subscribers may play downloaded tracks online or offline without restriction.

vi.Memory Video Export

• Memory video export weaves your photo through the composed song and produces an MP4/MOV file you can share, save, or post anywhere.
• Standard export — available to Free and Basic users — produces a 1080p H.264 video.
• HD export — Premium only — produces a 4K HEVC video.
• Exports are composed locally on your device. No upload to our servers takes place during export.

vii.Rewarded Ads for Bonus Quota (Free Plan)

• Free users may optionally watch rewarded video ads to earn bonus quota.
• Each completed rewarded ad grants additional quota (current default; subject to remote configuration).
• Rewarded ads are served by Google AdMob. Personalized ads are only shown after you grant App Tracking Transparency (ATT) permission; otherwise, non-personalized ads are shown.
• Subscribers do not see any ads and do not need this mechanism.

viii.Content Ownership

You retain ownership of the photos you provide. Subject to your compliance with these Terms, you also retain rights to the memory songs and memory videos generated through Picture Music, including for personal and commercial use. Picture Music does not claim ownership over the music or video you compose using the app.

You acknowledge that AI-generated audio is produced by a statistical model that has been trained on third-party data we do not control. We make no representation that any generated output is original, unique, or free from similarity to existing copyrighted works. You assume the risk of any third-party claim arising from your use of the generated content, particularly for commercial use.

ix.Acceptable Use

You agree not to use Picture Music, and not to upload photos or supply prompts, in any way that:

• depicts or sexualizes minors;
• promotes violence, self-harm, terrorism, or hate against any group;
• harasses, defames, or impersonates any person;
• contains content owned by others (including copyrighted photos, logos, or trademarks) that you do not have permission to use;
• attempts to generate audio designed to imitate the voice, style, or identity of a specific real person or recording artist without their explicit permission;
• violates any applicable law or third-party right.

You may not attempt to reverse-engineer, decompile, or otherwise interfere with the app’s normal operation. We reserve the right to remove content, suspend or terminate access, and cooperate with law enforcement for any violation.

x.Disclaimer

The service is provided “as is” and “as available” without warranties of any kind. We do not guarantee uninterrupted availability, specific creative results from the AI composer, or the continued availability of any third-party music source. Composer output is inherently non-deterministic; identical inputs may produce different songs on different runs. You are solely responsible for evaluating the suitability of any generated content for your intended use.

xi.AI Generation Details

Picture Music creates memory songs in two stages:

• On-device analysis. Your selected photo is analyzed locally on your device using Apple’s Vision framework. The photo itself never leaves your device and is not uploaded to our servers or to any third party.
• Off-device generation. A short, abstracted text description derived from the on-device analysis (for example, “warm sunset, two people, joyful”) is sent to our third-party AI provider (Replicate, running the ACE-Step model), which generates the audio track.

We do not use your photos, prompts, generated audio, or any other personal data to train, fine-tune, or improve any AI model. Our AI provider performs inference only on the abstracted text prompt we send. Our privacy practices around this data flow are described in our Privacy Policy.

xii.Reporting & Content Moderation

If you encounter generated content that you believe is objectionable, infringes a copyright, or otherwise violates these Terms, you can report it from within the app:

• Open the memory in question, tap the ··· menu, then tap Report; or
• Go to Settings › Help & Feedback and tap Report content or feedback.

You can also email us directly at jamiewang2026@163.com. We review reports and respond within 24 hours. We may remove content, suspend or terminate accounts, or take other action we deem appropriate.

xiii.Changes to These Terms

We may update these terms from time to time. Material changes will be reflected in the Last updated date above and surfaced in-app where appropriate. Continued use of the app after changes constitutes acceptance of the updated terms.
